1. Acceptance of Terms

By creating an account, browsing content, or otherwise interacting with the Platform, you signify your acceptance of these Terms and any supplemental policies referenced herein, including our Privacy Policy, Adult Content Disclaimer, and DMCA Policy. These Terms apply to all visitors, registered users, and any other person who accesses the Platform in any capacity.

We reserve the right to update or modify these Terms at any time without prior individual notice. The "Effective Date" at the top of this document reflects the date of the most recent revision. Your continued use of the Platform after any such changes constitutes your binding acceptance of the revised Terms. It is your responsibility to review these Terms periodically. If a revision materially reduces your rights, we will make reasonable efforts to notify registered users through the email address associated with their account or through a prominent notice on the Platform.

2. Eligibility

The Platform is intended exclusively for adults. You must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction if it is higher than eighteen, to access or use the Platform. By using the Platform, you represent and warrant that you meet this age requirement and that you are not barred from using the Platform under any applicable law.

The Platform contains AI-generated adult content, including sexually explicit text, AI-generated images, and voice interactions. If viewing, receiving, or interacting with such material is illegal in your jurisdiction, you must not use the Platform. You are solely responsible for ensuring compliance with all local, state, national, and international laws applicable to your use.

We reserve the right to request age verification at any time and to suspend or terminate accounts where we have reasonable grounds to believe the age requirement is not met. Any misrepresentation of age constitutes a material breach of these Terms.

3. Account Registration and Security

Certain features of the Platform, including persistent character memory, custom character creation, voice interactions, and photo replies, require you to create an account. When registering, you agree to provide accurate, current, and complete information and to update such information as necessary to keep it accurate.

You are solely responsible for maintaining the confidentiality of your account credentials, including your password. You agree to notify us immediately at support@18roleplayai.com if you become aware of any unauthorized access to or use of your account. We are not liable for any loss or damage arising from your failure to safeguard your account information.

You may not create more than one account per person, share your account with third parties, or transfer your account to another person without our prior written consent. Accounts created by automated means or under false pretenses will be terminated without notice.

4. Acceptable Use Policy

You agree to use the Platform solely for its intended purpose: engaging in AI-powered roleplay conversations with fictional AI characters for personal entertainment. All interactions on the Platform involve entirely fictional AI personas. No real persons are depicted, represented, or involved in any conversation, generated image, or voice interaction.

You expressly agree not to: (a) use the Platform to generate, solicit, or distribute any content involving minors in any sexual, suggestive, or exploitative context; (b) attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code or underlying algorithms of any part of the Platform; (c) use automated scripts, bots, crawlers, or other automated means to access the Platform or collect data; (d) impersonate any person or entity, or misrepresent your affiliation with any person or entity; (e) interfere with, disrupt, or place an undue burden on the Platform's servers or networks; (f) use the Platform to harass, stalk, threaten, or intimidate any individual; (g) upload viruses, malware, or any other harmful code; (h) attempt to access accounts, systems, or data not belonging to you; (i) use the Platform for any commercial purpose, including advertising or solicitation, without our express written permission; (j) circumvent any content filtering, moderation, or safety system implemented on the Platform.

Violation of this Acceptable Use Policy may result in immediate suspension or permanent termination of your account, with or without notice, at our sole discretion. We reserve the right to cooperate with law enforcement authorities and to report any activity that we reasonably believe may violate applicable law.

5. AI-Generated Content Disclaimer

All content produced by the Platform — including text responses, character dialogue, AI-generated images, voice outputs, scenario descriptions, and character personalities — is generated algorithmically by artificial intelligence systems and is entirely fictional. No AI-generated content represents real events, real persons, professional advice, or factual statements of any kind.

AI-generated characters on the Platform are synthetic personas. Their names, appearances, biographies, and personality traits are fictional constructs. Any resemblance to real individuals, living or deceased, is coincidental and unintended. The "memory" feature that allows characters to recall prior interactions is a technical mechanism for narrative continuity and does not constitute a relationship, obligation, or representation of sentience.

You acknowledge that AI systems may occasionally produce content that is inaccurate, nonsensical, repetitive, or inconsistent with prior interactions. We do not guarantee the quality, coherence, accuracy, or suitability of any AI-generated content. The Platform is provided for entertainment purposes only, and no AI output should be relied upon as legal, medical, financial, psychological, or any other form of professional advice.

We employ safety filters designed to prevent the generation of illegal content, including but not limited to content depicting minors. These filters operate at the model level and cannot be circumvented by user prompts. Any attempt to bypass these safety measures constitutes a violation of these Terms.

6. Intellectual Property Rights

All proprietary content on the Platform — including but not limited to the website design, user interface, visual elements, logos, trademarks, software code, and curated character profiles — is the exclusive property of 18 Roleplay AI or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.

AI-generated content produced during your interactions (text, images, voice) is created using our proprietary systems. To the extent that any intellectual property rights exist in AI-generated outputs, such rights are retained by 18 Roleplay AI. We grant you a limited, non-exclusive, non-transferable, revocable license to view and use AI-generated content solely for your personal, non-commercial purposes within the Platform.

You may not reproduce, distribute, publicly display, modify, create derivative works from, or otherwise exploit any Platform content or AI-generated output for commercial purposes without our prior written consent. The 18 Roleplay AI name, logo, and all related marks are trademarks of 18 Roleplay AI and may not be used without express written permission.

7. User-Generated Content

In the course of using the Platform, you may create content including custom character descriptions, scenario prompts, conversation inputs, and character configurations ("User Content"). You retain ownership of the original creative elements of your User Content to the extent protectable under applicable law.

By submitting User Content to the Platform, you grant 18 Roleplay AI a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, and process your User Content solely for the purpose of operating, maintaining, and improving the Platform and its AI systems. This license survives termination of your account with respect to anonymized or aggregated data used for system improvement.

You represent and warrant that you own or have the necessary rights, licenses, and consents to submit your User Content and to grant the foregoing license, and that your User Content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party.

We do not routinely monitor User Content but reserve the right to review, edit, or remove any content that we determine, in our sole discretion, violates these Terms or applicable law. We are not responsible for any User Content submitted by you or other users.

8. Subscription, Payments, and Refunds

The Platform offers both free and premium subscription tiers. Free accounts include access to the character roster, daily message allowances, and core roleplay features. Premium tiers unlock additional functionality such as higher message limits, priority response speed, voice interactions, AI-generated photo replies, unlimited custom character creation, and advanced memory management.

Premium subscriptions are billed on a recurring basis (monthly or annually, as selected at the time of purchase) through our authorized payment processors. By subscribing to a premium tier, you authorize recurring charges to your chosen payment method until you cancel. Prices are displayed in the currency indicated at checkout and may be subject to applicable taxes.

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; you will retain access to premium features until that date. We do not offer prorated refunds for partial billing periods. Refund requests for technical issues or billing errors should be directed to support@18roleplayai.com within fourteen (14) days of the charge in question.

9. Disclaimers and Limitation of Liability

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, 18 ROLEPLAY AI DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY AI-GENERATED CONTENT, CHARACTER RESPONSES, OR OTHER OUTPUT PRODUCED BY THE PLATFORM.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 18 ROLEPLAY AI, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00 USD). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

10. Indemnification

You agree to indemnify, defend, and hold harmless 18 Roleplay AI, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and legal costs) arising out of or relating to: (a) your use of or access to the Platform; (b) any User Content you submit, post, or transmit through the Platform; (c) your violation of these Terms; (d) your violation of any rights of a third party, including any intellectual property, privacy, or publicity rights; or (e) your violation of any applicable law, rule, or regulation.

This indemnification obligation shall survive the termination of your account and these Terms. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you agree to cooperate fully with our defense of such claim.

11. Termination

You may terminate your account at any time by using the account deletion feature in your settings or by contacting us at support@18roleplayai.com. Upon termination, your right to access the Platform ceases immediately, and all data associated with your account — including conversation history, character memories, custom characters, and account preferences — will be permanently deleted in accordance with our Privacy Policy.

We reserve the right to suspend or terminate your account, or restrict your access to the Platform, at any time and for any reason, including but not limited to: violation of these Terms, suspected fraudulent or illegal activity, extended periods of inactivity, or cessation of Platform operations. Where circumstances permit, we will provide notice of termination and the reason therefor, but immediate termination without notice is authorized in cases of serious violations.

Upon termination, all provisions of these Terms which by their nature should survive will survive, including without limitation: intellectual property provisions, warranty disclaimers, limitation of liability, indemnification, and the governing law and dispute resolution clauses.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which 18 Roleplay AI is established, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be resolved through the applicable courts of that jurisdiction.

Before initiating any formal dispute resolution, you agree to first contact us at support@18roleplayai.com and attempt to resolve the dispute informally for a period of at least thirty (30) days. If informal resolution is not successful, either party may proceed with formal legal proceedings as permitted by applicable law.

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.
